Terms of Use (EULA)

These Terms of Use ("Terms" or "EULA") constitute a legally binding agreement between you ("User" or "you") and Velum / SoftRift ("we," "us," or "our") governing your access to and use of the Velum mobile application and related services (the "App").

By downloading, installing, or using Velum, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use the App.

1. Description of Service

Velum is a premium mindfulness, focus timer, and visual relaxation application designed to help users cultivate productivity and mental clarity through gamified focus timers (Earth formation and meteorite destruction), breath bubble exercises, streak tracking, and ambient soundscapes.

2. Subscription Plans & In-App Purchases

Velum offers two service tiers:

• Spark (Free Tier): Provides access to basic focus timers, standard breath bubble resets, and core tracking functionality at no cost.
• Glow (Premium Subscription Tier): An optional auto-renewing subscription that unlocks unlimited daily breath bubble resets, the full 25-minute Earth formation timer, interactive meteorite destruction mechanics, our full ambient audio library, and future premium features.

A. Subscription Billing & Auto-Renewal Terms

In compliance with Apple App Store Review Guidelines (3.1.2) and Google Play Subscriptions policies, the following terms apply to all Velum Glow subscriptions:

1. Payment Confirmation: Payment will be charged to your Apple ID Account (for iOS users) or Google Play Account (for Android users) at confirmation of purchase.
2. Automatic Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period (monthly or annual).
3. Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the subscription tier you initially selected.
4. Managing Your Subscription: You can manage your subscriptions and turn off automatic renewal at any time after purchase by going to your Account Settings on the App Store (iOS) or Google Play Store (Android).
5. Forfeiture of Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to Velum Glow.
6. Price Changes: We reserve the right to adjust subscription pricing at our discretion. Any price changes will take effect at the start of the next subscription period following reasonable notice provided by Apple or Google.

B. Refunds

All in-app purchases and subscriptions are processed and managed directly by Apple App Store or Google Play Store. Velum does not have the ability to process billing refunds directly. To request a refund, you must contact Apple App Store Support or Google Play Customer Service in accordance with their respective refund policies.

3. User License & Restrictions

Subject to your compliance with these Terms, Velum grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App for your personal, non-commercial use on compatible mobile devices that you own or control.

You agree NOT to:

• Modify, reverse-engineer, decompile, decrypt, or disassemble the App or any of its proprietary source code.
• Copy, adapt, alter, or create derivative works of the App's visual assets, animations, or soundscapes.
• Use the App for any unlawful, fraudulent, or malicious purpose.
• Attempt to bypass, exploit, or circumvent our subscription verification mechanics or cloud database security rules.

4. User Accounts & Deletion

• Account Security: You are responsible for maintaining the confidentiality of your authentication credentials (via Google Sign-In or Sign in with Apple) and for all activities that occur under your account.
• Account Deletion: You may terminate your relationship with Velum at any time by deleting your account inside the App under Profile (You) -> Delete Account. Deleting your account permanently wipes your user progress and Cloud Firestore data from our servers. Please remember to cancel your active store subscription separately in your device settings.

5. Intellectual Property Rights

All rights, title, and interest in and to Velum—including all UI/UX designs, graphics, illustrations, Earth and meteorite VFX animations, code, audio recordings, trademarks, and logos—are the exclusive property of Velum / SoftRift and are protected by international copyright, trademark, and intellectual property laws.

6. Disclaimer of Warranties

VELUM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF BUG OR SERVER OUTAGES.

No Medical Advice: Velum is a productivity and relaxation tool. It is not a medical device, nor is it intended to diagnose, treat, cure, or prevent any physical or mental health condition. Always seek the advice of a qualified healthcare professional with any questions regarding mental health or medical conditions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VELUM, ITS CREATORS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR ACCESS TO OR USE OF THE APP.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be resolved through good-faith negotiation or in the competent courts of jurisdiction.
